- Platform refers to the Lynkist WhatsApp business communication system and related technologies
- Account refers to your registered user account with Lynkist
- Content refers to text, images, videos, documents, and other materials transmitted through our Platform
- Subscription refers to paid access to premium features and services
3. Eligibility
3.1 Age Requirement
You must be at least 18 years of age to use our Services. By using Lynkist, you represent and warrant that you meet this age requirement.
3.2 Business Use
Our Services are designed for business and professional use. You represent that you have the authority to bind any business entity on whose behalf you are using our Services.
4. Account Registration and Security
4.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You must maintain and promptly update your account information
- You are responsible for maintaining the confidentiality of your account credentials
- You must have a valid WhatsApp account to use our Services
4.2 Account Security
- You are solely responsible for all activities that occur under your account
- You must immediately notify us of any unauthorized access or security breach
- We are not liable for losses arising from unauthorized use of your account
- You may not share your account credentials with others

- Interfere with or disrupt the integrity of our Services
- Reverse engineer, decompile, or disassemble our platform
- Use bots, scripts, or automated tools without authorization
7. Subscription and Payment Terms

- All fees are in INR unless otherwise stated

- You represent that you have all necessary rights to grant this license
- You are solely responsible for your content

10. Service Availability and Modifications

- We strive for high availability but do not guarantee uninterrupted access
- Services may be unavailable due to maintenance, updates, or technical issues

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of profits, revenue, data, or business opportunities
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
12. Indemnification
You agree to indemnify, defend, and hold harmless Lynkist, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of our Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your content or conduct
13. Term and Termination
13.1 Termination by Us
We may suspend or terminate your access immediately, without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Conduct that harms our business or reputation
- Any reason at our sole discretion
13.2 Effect of Termination
Upon termination:
- Your right to use our Services ceases immediately
- We may delete your account and data after a retention period
- Sections that by nature should survive (including liability limitations, indemnification, and dispute resolution) remain in effect
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes shall be brought in the courts of Pune, Maharashtra, India, and you consent to personal jurisdiction there.

Special Provisions by Jurisdiction
For EU/EEA Users
You have additional rights under EU consumer protection laws and GDPR. Nothing in these Terms limits those statutory rights.
For UK Users
These Terms are subject to UK consumer protection laws. You have statutory rights that cannot be limited by these Terms.
For Indian Users
These Terms comply with the Information Technology Act, 2000 and other applicable Indian laws. Disputes are subject to Indian jurisdiction as specified above.
